Does Your State Regulate Home Warranty Companies?

There is no federal home warranty regulator. Each state decides whether home warranty companies must be licensed or registered, which agency oversees them, and what rules they follow. Here's how it works and where to go in your state.

How states regulate home warranties

Home warranties are usually treated as service contracts, not insurance. Depending on the state, that means the company may need to:

  • Obtain a license, permit or registration before selling plans
  • Post a surety bond or keep financial reserves so claims can be paid
  • File contract forms, and sometimes rates, with the state
  • Include required disclosures, cancellation and refund terms in the contract
  • Respond to consumer complaints filed with the state agency

Oversight usually sits with the state insurance department, but some states assign it to a licensing board, consumer affairs office, secretary of state or the attorney general. Even in states with no specific program, deceptive or unfair practices are covered by general consumer protection laws.

The state has a law or licensing program that names home warranties, home service contracts or residential service contracts.

General service contract law

Home warranties fall under a broader law covering service contracts, often with registration, bonding or disclosure rules.

No specific program

We found no home warranty licensing or registration program; general consumer protection laws still apply and the attorney general handles complaints.

Before you buy: check the company

  1. Find your state below and open the agency link.
  2. Search the agency's license or registration lookup for the company's name, if one exists.
  3. Read the sample contract: coverage caps, exclusions, service fee, waiting period and cancellation terms.
  4. Check the complaint history with the state agency and the Better Business Bureau.

If you have a dispute with a home warranty company, contact the company first, then file a complaint with the agency listed for your state.
